General Terms and Conditions (GTC) – Private Customers (Consumers)

1. Scope
These General Terms and Conditions (GTC) apply to all contracts between Profis-24.de (hereinafter referred to as “Provider”) and consumers within the meaning of § 13 BGB regarding services such as removals, clearances, household clearances and similar services.
Deviating or supplementary agreements are only valid if they have been confirmed in writing by the provider.
2. Conclusion of the contract
The contract is concluded by acceptance of an offer from the provider or by a verbal, written, or electronic order from the customer.
The contract text is stored by the provider and will be sent to the customer in written form upon request.
3. Scope of Services
The scope of services is defined in the individual agreement or the prepared offer.
Changes or additional services must be in writing (e.g., by email).
4. Prices and Payment Terms
All prices are final prices including statutory VAT , unless explicitly stated otherwise.
Payment is due immediately upon completion of services without deduction , unless otherwise agreed.
Payments can be made in cash or by bank transfer .
In case of late payment, the provider is entitled to charge default interest at the statutory rate (§ 288 BGB) .
5. Right of withdrawal for consumers
Cancellation policy
You have the right to withdraw from this contract within 14 days without giving any reason.
The cancellation period is 14 days from the day the contract is concluded .
To exercise your right of withdrawal, you must inform us (

) of your decision to withdraw from this contract by means of a clear statement (e.g. by letter or email).
To meet the deadline, it is sufficient that you send the notification of exercising your right of withdrawal before the withdrawal period expires.
Consequences of the revocation
If you withdraw from this contract, we will reimburse all payments received from you without undue delay and in any event no later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.
Expiry of the right of withdrawal
The right of withdrawal expires if the provider has fully performed the service and the customer has previously expressly agreed that the provider may begin performing the service before the end of the withdrawal period.
6. Withdrawal and Cancellation
Regardless of the statutory right of withdrawal, the following applies:
Cancellations up to 48 hours before the appointment are free of charge.
For later cancellations, the provider may demand 50% of the agreed price as compensation for the loss.
7. Liability
The provider is liable:
unlimited for damages resulting from injury to life, body or health;
In cases of intent and gross negligence , the full extent of the penalty applies;
In cases of slight negligence, liability is limited to breaches of essential contractual obligations (cardinal obligations)
and is restricted to the foreseeable damage typical for this type of contract .
Liability for indirect damages or lost profits is excluded.
Für besonders empfindliche, wertvolle oder gefährliche Güter wird eine Haftung nur übernommen, wenn dies vorher schriftlich vereinbart wurde.
8. Versicherung
Transportierte Güter sind im Rahmen einer bestehenden Transportversicherung abgesichert.
Schäden sind unverzüglich nach Leistungserbringung schriftlich anzuzeigen.
9. Datenschutz
Personenbezogene Daten werden ausschließlich zur Vertragsabwicklung verwendet und gemäß der Datenschutz-Grundverordnung (DSGVO) verarbeitet.
Eine Weitergabe an Dritte erfolgt nur, soweit dies zur Vertragserfüllung erforderlich ist (z. B. Transportunternehmen, Versicherungen).

10. Gerichtsstand und anwendbares Recht
Es gilt deutsches Recht.
Für Verbraucher gilt der gesetzliche Gerichtsstand ihres Wohnsitzes.
Die Anwendung des UN-Kaufrechts ist ausgeschlossen.

1. Geltungsbereich
Diese AGB gelten für alle Verträge zwischen Profis-24.de und Unternehmen, juristischen Personen des öffentlichen Rechts oder öffentlich-rechtlichen Sondervermögen.
2. Vertragsabschluss
Ein Vertrag kommt durch schriftliche Bestätigung oder Annahme eines Angebots zustande.
Nebenabreden oder Änderungen bedürfen der Schriftform.
3. Leistungsumfang
Der Leistungsumfang ergibt sich aus dem jeweiligen Angebot oder der schriftlichen Vereinbarung.
4. Preise und Zahlungsbedingungen
Alle Preise verstehen sich zuzüglich gesetzlicher Mehrwertsteue, oder nach Vereinbarung.
Rechnungen sind innerhalb von 14 Tagen nach Rechnungsdatum ohne Abzug zahlbar.
Bei Zahlungsverzug werden Verzugszinsen gemäß § 288 Abs. 2 BGB (9 Prozentpunkte über Basiszinssatz) fällig.
5. Rücktritt und Stornierung
Stornierungen bis 5 Werktage vor Leistungstermin sind kostenfrei.
Bei späteren Stornierungen ist der Anbieter berechtigt, 50 % der Auftragssumme als Ausfallentschädigung zu verlangen.
6. Haftung
Der Anbieter haftet:
uneingeschränkt bei Vorsatz und grober Fahrlässigkeit,
bei leichter Fahrlässigkeit nur für die Verletzung wesentlicher Vertragspflichten,
beschränkt auf den vertragstypischen, vorhersehbaren Schaden.
Eine Haftung für mittelbare Schäden oder entgangenen Gewinn ist ausgeschlossen.
Für die ordnungsgemäße Verpackung und Sicherung der Güter ist der Auftraggeber verantwortlich, sofern nichts anderes vereinbart wurde.
7. Versicherung
All transports are covered by existing transport insurance .
8. Data protection
Data is processed solely for the purpose of contract fulfillment and will not be disclosed to third parties
unless there is a legal obligation to do so or explicit consent has been obtained.
Processing is carried out in accordance with the GDPR .

9. Jurisdiction and applicable law
German law applies .
The place of jurisdiction for all disputes is the registered office of Profis-24.de .
The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
10. Severability Clause
Should any provision of these Terms and Conditions be invalid or unenforceable,
the validity of the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by a valid provision that most closely approximates its intended economic purpose.
